Black teens beat elderly white man to near death
A teen arrested in the beating of a 94-year-old man will face adult charges in the incident.
Prosecutors announced Friday that they will move the case to Superior Court and have him tried as an adult for charges including aggravated assault, aggravated battery and gang charges.
The teen and an 11-year-old were arrested in last week’s attack of World War II veteran Paul Smallwood. Smallwood’s family members said he was hit over the head repeatedly with a rock, while robbed of $27 and a cell phone. He has been in intensive care ever since.
The young suspects were due in court for an arraignment on Friday, but lawyers waived the arraignment.
The 11-year-old’s case will remain in juvenile court, but his mother said that her son is a good boy. She said her son, who has only lived in the area for three weeks, was at Smallwood’s Marietta apartment during the attack, but didn’t participate in the beating.
“I’m not really worried, because I know my son is not the one who hit him,” his mother told Channel 2’s Ross Cavitt.
